BOROUGH OF CONSHOHOCKEN
COUNCIL MEETING
March 17, 2010
The President of Council Mr. Paul McConnell called the meeting to order. Mr. Stokley gave the Prayer of Council and the Pledge of Allegiance was said. Members of Council present at the meeting were: Mr. Jason Salus, Mr. James Griffin, Mr. Edward Phipps, Ms. Carolyn Maye, Mr. Paul McConnell and Mr. Robert Stokley. Mr. Anthony Tucci was absent.
A hearing was held for a Waiver of Off-Street Parking for 103-105 Fayette Street. Motion was made by Mr. Griffin to accept the Waiver on the condition that two (2) parking stickers are purchased for employees when available. Motion was seconded by Mr. Salus. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Stokley to approve Leo Costello as Deputy Fire Chief for the Borough. Motion was seconded by Mr. Phipps. All voted in favor except Mr. Tucci who was absent. Motion passed.
Mayor Frost swore in Mr. Leo Costello as Deputy Fire Chief.
Megan, from the Society of Progressive Drinkers gave a contribution of $317.00 from their Guppy’s fundraiser towards the July 3rd festivities.
Mr. Phipps announced that Pepperoncini’s Restaurant donated $1,000.00 for the fireworks.
Mr. Marabella announced that there is a worksheet attached detailing all open actions items for Council and Staff.
Mr. Marabella announced that Ethics Statements are due May 1, 2010.
Mr. Marabella reported that the Engineer’s report included work which was being completed at Sutcliffe Park.
Mr. Marabella announced there was an executive session before and that there will be one after as well concerning Tax Appeals and Real Estate matters.
Mr. Marabella gave the Treasurer’s report for the month of February 2010.

A motion was made by Mr. Phipps to accept the Treasurer’s report and pay all Borough bills. Motion was seconded by Mr. Stokley. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Stokley to approve the minutes of the February 17, 2010 Council meeting. Motion was seconded by Ms. Maye. All voted in favor except Mr. Tucci who was absent. Motion passed.
An announcement was made that the Shade Tree Commission will have a Bare Roots Tree planting on March 27, 2010.
A motion was made by Mr. Salus to accept a new Shade Tree Commission Ordinance. Motion was seconded by Ms. Maye. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Salus to appoint Todd Camden to the Shade Tree Commission. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Salus to accept an Ordinance to report lost or stolen firearms. Motion was seconded by Mr. Phipps. All voted in favor except Mr. Tucci who was absent. Motion passed.
Mr. Salus reported that the first Business Development Commission meeting was held and about 15 people attended.
A motion was made by Mr. Griffin to approve a Resolution for Moratorium on prohibiting alcoholic beverages at outdoor cafes. Motion was seconded by Mr. Phipps. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Griffin to accept the banner application and fee of $200 to hang a banner on Fayette Street. Motion was seconded by Ms. Maye. All voted in favor except Mr. Tucci who was absent. Motion passed.
An announcement was made that the Personnel Committee is reviewing applications/resumes for the Code Enforcement position. They anticipated on having someone in place by early May.
An announcement was made that the Borough received a $3,500 grant to help with the Farmer’s Market expenses this year.
A motion was made by Mr. Stokley to accept Cresa Partner’s marketing proposal for the Borough real estate properties. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
An announcement was made that the next Environmental Council Committee is scheduled for March 23, 2010.
A motion was made by Mr. Salus to waive the permit fees which the Borough does not have to pay to a third party for the Colonial Neighborhood Council’s repairs. Motion was seconded by Mr. Stokley. All voted in favor except Mr. Tucci who was absent. Motion passed.
An update was given by the Engineer on the Sturbridge Builders First and Wood Street road dedication.
An update was given by the Engineer on the work being done at Haines Park and the Plymouth Creek Channel.
Inspection reports were given for the maintenance bond release for the CDBG Curb Cut program. The Bonding Company is to be notified that the work needs to be completed.
A motion was made by Mr. Stokley to award the Public Works Pole barn bid to B&B Pole Buildings for $86,486.00 for the Base Bid 1 and $9,333.00 for Base Bid 2. Motion was seconded by Mr. Phipps. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Stokley to authorize the Engineer to begin the 2010 Road Program. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
The Engineer requested that Mike Gerber’s office be asked for help with the handicapped ramps on Fayette Street. This will be discussed at the next Work Session.
An announcement was made that the License and radio work for the Borough’s radios will cost an estimated $2,000 which is not budgeted. This will be discussed at the next Work Session.
A motion was made by Mr. Stokley to approve placing a tree and lighting for $1,807 by the Shaffer property as part of the 2009 Road Program. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Stokley to authorize the Manager to release from escrow $46,372.50 to Erb Mascio Builders for 201 East 7th Avenue. Motion was seconded by Ms. Maye. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Phipps to authorize the Solicitor to advertise the proposed Litter Ordinance for the Borough. Motion was seconded by Mr. Stokley. All voted in favor except Mr. Tucci who was absent. Motion passed.
An announcement was made that the Engineer is working on the updates to the Parks and Recreation Plan to include the Fellowship House.
Mr. Phipps announced some of the events planned to help raise funds for the 3rd of July celebration.
An announcement was made that the Annual Albert C. Donofrio Classic will be held at the Fellowship House beginning March 29th and ending April 27th.
A motion was made by Mr. Phipps to approve payment to Richard’s Electric in the amount of $1,225.00 for installing three (3) additional light fixtures at the “A” Field and pay for it out of the Parks and Recreation Impact Fee. Motion was seconded by Mr. Stokley. All voted in favor except Mr. Griffin who recussed himself because he is employed by Richard’s Electric and except Mr. Tucci who was absent. Motion passed.
Mrs. Savage will email Borough Council and the Fellowship House Board to set up a meeting between the two boards.
The Mayor’s report for the month of February
A motion was made by Mr. Stokley to accept the Police Report for the month of February 2010. Motion seconded by Mr. Phipps. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Salus to authorize the Solicitor to advertise an Ordinance providing for the prohibition of the parking of certain vehicles with registered gross weight in excess of 9,000 lbs. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Griffin to accept an Ordinance amending the Police Pension Plan to comply with ACT 600 of 1956 and amended by ACT 51 of 2009. Motion was seconded by Ms. Maye. All voted in favor except Mr. Tucci who was absent and Mr. Stokley who was out of the room. Motion passed.
Mrs. Savage will email Borough Council to set up tours of the Police Department.
An announcement was made that the St. Patrick’s Day Parade will be held on Saturday, March 27, 2010, beginning at 2:00 pm.
Mr. McConnell asked the staff to include Agenda deadlines on the Workshop Agenda.
Ms. Hildebrand announced that the Fellowship House’s Easter Egg Hunt will be held on Saturday.
A motion was made by Mr. Phipps for a Resolution for $234,090 for completing elements of the Streetscape Project between the 100 and 700 Block. Motion was seconded by Mr. Stokley. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Phipps for a Resolution for $19,320 for way finding and information signage from the river to Town. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Stokley to extend the contracts of the Borough’s Housing Consultants, Nancy Nugent and Carl Royer. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
A motion was made by Mr. Stokley to allow a dedicated parking space for a resident at 322 East Hector Street. Motion was seconded by Mr. Griffin. All voted in favor except Mr. Tucci who was absent. Motion passed.
Council granted permission to Montgomery County Economic Development Corporation to hold one of their “creative financing in a tough economy” seminars at 720 Fayette Street.
Mr. McConnell announced that the 2010 Census reports have gone out. He kindly asked all residents to complete their census and return promptly. This allows the Borough to take advantage of future grants.
A motion was made by Mr. Stokley to send Plymouth Township Council a letter requesting them to work with the Borough to submit a request to DEP to help us resolve flooding issues in Plymouth Creek. Motion was seconded by Mr. Phipps. All voted in favor except Mr. Tucci who was absent. Motion passed.
Mr. Marabella reported that our insurance coverage proposals are due April 1, 2010 and Council is okay with the staff moving forward with these proposals.
PUBLIC COMMENTS:
Before the Meeting:
Gerry McTamney wanted to thank the Public Works crew on removing all the snow. He also wished everyone a Happy St. Patty’s Day. Mr. McTamney also commented that many pavements had been snow covered and questioned if citations were issued.
Mary Jo McGee, 341 W. 5th Avenue, expressed concern over water damage to the back of her residence and questioned some issues within the alley. Ms. Carolyn Maye instructed her to give her the information and she would investigate this matter further
After the Meeting:
Mayor Frost announced that Conshohocken #2 Fire Department will be selling Easter Flowers on April 1st and April 2nd from 10:00 am until 8:00 pm and on April 3rd from 10:00 am until 5:00 pm.
Mayor Frost announced that the Conshohocken Car Show will be held on Saturday, June 5, 2010.
